Terms and Privacy Policy

Summary

Metadata Games is a free and open source software (FOSS) online game system for augmenting access to archival records. Data from this software is used to tag media assets such as images, audio, and moving images. This document describes what will happen to your contributions if you choose to contribute, what data we collect, how we use it, and how we protect it.

“Media Assets” is defined as the images, audio, and moving image artifacts — often under copyright–fed into and subsequently utilized by Metadata Games. “Services” means other applications, functionality, or services delivered to you by Metadata Games, including the website, games, and database system.

By accessing the Metadata Games website (the “Site,” defined as all pages at https://metadatagames.org/ , http://metadatagames.com/, http://tiltfactor.org, and their subdomains), or by downloading or using Metadata Games apps or browser activities, you agree to be bound by the following terms:

What you agree to if you play Metadata Games

The goal of this project is to generate tags for library and archival media artifacts, and to assist in research on future metadata activities. All metadata collected will be available to the public pursuant to Creative Commons’ CC0 public domain dedication. Tiltfactor and Dartmouth College claim the right to use, in perpetuity, the tags generated by the system. More info about CC0 can be found at http://creativecommons.org/about/cc0 .

Obligations and Restrictions on Use

Your use of the Services is subject to the following restrictions and obligations:

  1. You may not sell or rent the Services to others.
  2. You may not use the Services in any way that is unlawful, fraudulent, defamatory, obscene, or otherwise harmful, including, but not limited to, displaying content in a manner that violates any applicable laws, statutes, or regulations, infringes or violates any other person or entity’s rights, or that Tiltfactor at Dartmouth College, in its sole discretion, finds to be obscene or defamatory.
  3. You agree to comply with all applicable laws, including, but not limited to, any privacy laws, as well as Tiltfactor and Dartmouth College policies when you use the Services.
  4. You may not use the Services in any way that interferes with the operation of the Services or impacts or harasses any other User, host, or network, or circumvents any of the Services’ security.

Collection Content

The Media Assets displayed as part of the Site or associated Metadata Games for browser and mobile are subject to the rights granted for each Media Asset at its respective host institution. Using these services does not grant you any right to ‘scrape’ or copy any of of the Media Assets from the Site or associated games. If you do, you do so at your own risk, and are fully liable for any damages that may arise out of this behavior. By copying any Media Assets you may violate intellectual property agreements with participating institutions. If you would like information how to license these Media Assets, please contact the relevant rights-holder.

Age

Any users under the age of 13 need parental supervision to play Metadata Games.

Privacy Policy

Data we collect

If you register with Metadata Games, we ask you to create a username and supply your e-mail address. Your e-mail address is not visible to other users, but others may see your username.

Usage information: This project is a not-for-profit project. We do not aggregate data to sell it. We do monitor how people use our website and games, and aggregate general statistics about users and traffic patterns as well as data about how users respond to various site features. This includes, among other things, recording:

  • When you log in.
  • Pages you request.
  • Tags you submit while playing a Metadata Game.

Metadata Games may place small files on your computer’s hard drive known as a “cookies,” in order to personalize your visits to the Site. Most web browsers automatically accept cookies, but you may prefer to modify your browser settings to decline them. If you decline cookies from Metadata Games then functionality may be impaired.

What is shared with third parties

Data associated with your username, or your IP address in association with your email address or username, will never be disclosed to third parties except in very limited circumstances, such as complying with law or legal process, working with consultants assisting us with the Site, or monitoring and improving the security of our network. We will never share data we collect about you unless it is necessary to accomplish our research goals and cannot be associated with you or your username. Even in these exceptional cases, we will attempt to preserve your privacy. Specifically, we may share your anonymized data with research study participants, other researchers, or in scholarly work describing our research. In short, we do not sell data about you or any of our users. Metadata Games employs Google Analytics to collect and analyze data about site usage that is not personally identifiable. Click on the links to view their privacy policies. Anonymized usage or gameplay data may be studied and shared with others for research purposes.

Metadata Games may terminate, suspend, or block your account at any time. Reasons for this include but are not limited to engaging in abusive behavior; creating a false identity; disseminating or transmitting spam, advertisements, or solicitations; posting material that infringes a copyright, trademark or patent right, trade secret or other legal right of any person, corporation or institution; collecting, printing out, reproducing, distributing, or otherwise making available or using any personally-identifiable information about other users; disseminating or transmitting viruses, Trojan horses, worms, defects, date bombs, time bombs, malware, spyware, or other items of a destructive nature or any other malicious code or program; using the Site in any manner that could damage or overburden other sites; using the Site in any manner that would interfere with any other party’s use of the Site.

Disclaimer of Warranty / Limitation of Liability

Metadata Games is a project of faculty members, staff, students, and researchers at Tiltfactor and Dartmouth College. You agree that your use of the Site shall be at your own sole risk. To the fullest extent permitted by the law, Tiltfactor and Dartmouth College disclaims all warranties, express or implied, in connection with the Site and your use thereof. Tiltfactor and Dartmouth College make no warranties or representations about the accuracy or completeness of the Site’s content (including User-Generated Content and Third-Party Content) or the content of any websites linked to this Site and assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies in content; (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site; (3) any unauthorized access to or use of Tiltfactor and Dartmouth College’s secure servers and/or any and all personal information and/or financial information stored therein; (4) any interruption or cessation of transmission to or from the Site; (5) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Site by any third party; and/ or (6) any errors or omissions in any content or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Site. You assume all risk as to the quality, function, and performance of the Site, and to all transactions you undertake on the Site, including without limitation submission of any User-Generated Content.

You agree that Tiltfactor and Dartmouth College will not be liable to you for any loss or damages, either actual or consequential, arising out of or relating to these terms, or your (or any third party’s) use or inability to use the Site, or your placement of User-Generated Content on the Site, or your reliance upon information obtained from or through the Site, or your communications with other users of the Site. In particular, Tiltfactor and Dartmouth College will have no liability for any consequential, indirect, punitive, special or incidental damages, whether foreseeable or unforeseeable, (including, but not limited to, claims for defamation, errors, loss of data, or interruption in availability of data), arising out of or relating to these terms, your use or inability to use a site, your placement of content on the Site, your reliance upon information obtained from or through a Site, or your communications with other users of the Site, whether based in contract, tort, statutory or other law, except only in the case of death or personal injury where and only to the extent that applicable law requires such liability.

Indemnification

All risks associated with your use of the Metadata Games software, including liability for any consequential or incidental damages or damage to electronics hardware or software, and the entire risk of use, including without limitation any damages, including those to your electronics hardware or software, reside with you. You hereby indemnify, defend and hold harmless Tiltfactor, Dartmouth College, and all its affiliates, employees, faculty members, fellows, students, volunteers, members of their governing boards and agents (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of this User Agreement or the foregoing representations, warranties and covenants. You similarly hereby indemnify, defend and hold harmless any participating Metadata Games institution.

Further information and requests

Tiltfactor and Dartmouth College and the Metadata Games participating institutions reserve the right to change this Agreement at any time. By accessing Metadata Games after modifications have been posted, you agree to be bound by the modified terms.
